Abdul Baha had appointed two pillars of the position of guardian of the faith and the foundation of universal house of justice. He considered the universal house of justice as infallible and had appointed the position of the faith guardian as the supervisor of the council:
"اما بیت عدل الذی جعله الله مصدر کلّ خیر و مصوناً من کل خطاء"
“However, the universal house of justice which is appointed as infallible by God must be formed by the public election… and the faith guardian is the holy chairman of this assembly and is the greatest and distinguished one of it.[1]”
By committing a sin by the members of the universal house of justice and quitting chastity, Abdul Baha believed the guardian of the faith was responsible to confront them:
“ If a member commits a sin which harm the public, the guardian of the faith is merited to fire him. Then people must elect another person.[2]”
Nevertheless, according Abdul Baha’s confession, the so-called council of the universal house of justice has been copied after the western parliaments: “The divine universal house of justice must be elected based on the orders and arrangements of the European ones.[3] ”
This decision confronted the legitimacy crisis during the way because:
1. Contrary to the Excellency Abdul Baha’s prediction, Shoqi Effendi was abortive and one of the two pillars of the Baha’ism leadership was practically omitted.
2. Contrary to elections, all the universal house of justice members are appointed again unless one of them isn’t able present at the council due to indolence or death in order for another person to be appointed.
3. According to the UHJ orders all Baha’i people can participate at the elections to be the member of the UHJ if they gain votes. This claim isn’t acceptable due to two reasons. In which the UHJ elections even the attendants of the national assemblies are allowed to be entered as candidates? Have you ever seen a woman to be member of the council?
4. In the UHJ election, the responsibility for supervision has been taken over by the guardian of the God’s faith. Now when there isn’t any guardian, the elections of isn’t legitimate even with existing the Baha’ism organization.
Claiming for the position of chastity, the vague elections have been practically changed into a dictatorial system in the Baha’i leadership. The reason for this claim is that the main reason for changing the members of the universal house of justice is the people’s death and indolence.[4] Consequently, Francesco Ficicchia [5] states explaining the structure of the Baha’ism universal organization that according to him the Baha’ism teachings and beliefs have been merely established in the service of accepting and obeying blindly. In this organization, a person who obeys this main principle will be excommunicated.[6]
Francesco Ficicchia believes that the political aims of the universal organization of Baha’ism are dictatorial and are not democratic and are extremely against freedom. He believes the severe political beliefs of the leadership of Baha’ism universal organization are originated from fascist tendencies because the Baha’ism organization has been changed into a legal power and the only theological organization in the Baha’i community from 1963 A.D. on when the theological source transferred to the universal house of justice. Ficicchia calls it making the Baha’i community church.
According to him, the members of the Baha’ism organization confront urgent excommunication by the Baha’ism organization when the members offer the critical thought, the freedom of speech, criticism of regulations, censorship of studying the opponents’ works. He believes that the Baha’i teachings have been changed into ideological ones which will be replaced by an independent thought.[7]
